PRIVACY POLICY

This is a summary of our new privacy policy which takes effect on Apr 25th, 2020. It covers every Desi Channel TV website that links here and all of the products and services contained on those websites. 

Our privacy commitment: Desi ChannelTv has never sold your information to someone else for advertising. This policy tells you what information we do collect from you, what we do with it, who can access it, and what you can do about it.

Part I – Information Desi ChannelTv collects and controls

We only collect the information that we actually need. Some of that is information that you actively give us when you sign up for an account. We store your name and contact information.

What we do with your information

We use your information to provide the services you’ve requested, create and maintain your accounts, and keep an eye out for unauthorized activity on your accounts. We also use it to communicate with you about the products you’re currently using, your customer support requests, new products you may like, chances for you to give us feedback, and policy updates. We analyze the information we collect to understand user needs and to improve our websites and services.

We’re required to have a legal basis for collecting and processing your information. In most cases, we either have your consent or need the information to provide the service you’ve requested from us. When that’s not the case, we must demonstrate that we have another legal basis, such as our legitimate business interests.

You can also disable cookies to prevent your browser from giving us information, but if you do so, certain website features may not work properly. We completely disable third-party cookies from all Desi Channel TV websites and products.

We limit access to your personal information to our employees only. If we share your information with other parties (like developers, and service providers), they must have appropriate security measures and a valid reason for using your information, typically to serve you.

The European Economic Area (EEA) provides certain rights to data subjects (including access, rectification, erasure, restriction of processing, data portability, and the right to object and to complain). Desi Channel TV undertakes to provide you the same rights no matter where you choose to live.

We keep your personal information for as long as it is required for the purposes stated in this Privacy Policy.

There are some limitations to the privacy we can promise you. We will disclose personal information if it’s necessary to comply with a legal obligation, prevent fraud, enforce an agreement, or protect our users’ safety. Third-party websites and social media widgets have their own separate privacy policies. Always check the relevant privacy policy before sharing personal information with third parties.

Introduction

Khind Enterprise Inc. and /or its associates, related parties, successors and assigns (collectively hereinafter referred to as “us”, “we” or “our” respects your privacy. This Privacy Statement explains what information we collect through our websites (the “Desi ChannelTv.com”, “Sites”), through our products and when you contact us for support, how we use that information, and what choices you have.

The Sites may contain links to other websites. This Privacy Statement does not apply to the practices of any company or individual that Khind Enterprise Inc. does not control or any websites that you link to from the Sites. You should carefully review the privacy policies of any websites that you visit from ours to learn more about their information and privacy practices. The collection and use of your personal information shall be governed by such other party or site’s privacy policy. Khind Enterprise Inc. is not responsible for their privacy practices.

Please take a few moments to read this Privacy Statement. By accessing the Sites or using a Desi Channel TV product, you agree to accept the terms and conditions of this Privacy Statement and are aware that our policies may change in the future.

Acceptance of Privacy Policy

1.1 This Privacy Policy is supplementary to the General Terms and Conditions(“T&C”) and is incorporated into the T&C by this reference.

1.2 By providing us with your personal information in any way, you agree to be bound by this Privacy Policy. 

1.3 If you are accessing or using our website or application, please be aware that our website or application may contain links to websites of third parties. By clicking on such links, you may be transferred to the website of the third party. We not responsible in any way for the privacy practices of such third parties and you are advised to view and read the privacy statements issued by the third parties to ensure that you understand and agree to the same.

What information we collect

In various places on the Sites and through the Desi ChannelTv products, we collect “Personally Identifiable Information” such as your name, mailing address, telephone number, email address, or other information that can be used to identify you or contact you. For example, we collect this information when you create an account, register for our message boards, sign up for our email newsletter, and purchase from our website or register a Desi ChannelTv product, download a software update, enter sweepstakes or participate in surveys, promotions, and give-away. From time to time in the future, we may offer software updates, upgrades, additional features, services and promotional opportunities that would require you to submit Personally Identifiable Information to participate.

We also collect “Anonymous Information” such as your IP address, the type of browser you use, the pages on our Sites that you visit, the search terms that you enter or the advertisements that you click. Anonymous information can and will NOT be associated with Personally Identifiable Information.

Like many Internet sites, we also use “cookies” to collect information. A cookie is a small data file that we transfer to your computer and is stored on your hard drive. When you visit our Sites the cookie identifies your computer to us so that you do not have to re-register each time you visit. We also use cookies to measure the traffic to and usage of our site and it’s different services and features, and other miscellaneous uses.

We also collect the personal information of third parties that is provided by visitors who submit that personal data through our Sites, in connection with, for example, referrals or gift purchases.

Desi Channel TV products upload usage information to Desi Channel TV as part of their normal functioning. The collected information includes the specific identifiers of streams played, duration played, various quality measures, error logs, software version numbers, and other usage statistics. Usage information uploaded from Desi Channel TV products is personally identifiable by product serial number. In some cases, serial numbers are associated with personally identifiable information for customer service and support.

The information collected from many users is aggregated for analysis and, in some instances, made generally available anonymously to users of Desi Channel TV products and Desi Channel TV services. For example, Desi Channel TV may use such information to provide features such as lists of popular videos. Desi Channel TV may also use the personally identifiable information to make content recommendations to individual users.

If you do not wish Desi ChannelTv to use your information as described in this section, please follow the procedure in “What Choices You Have” below.

We do not intend that children will use the Sites. We do not solicit or knowingly collect information from children under 13 years of age, nor will we accept registration from them.

How we use the information we collect

We use Personally Identifiable Information that you provided us to perform the services for which the data was collected, such as customer support e-mail alerts

Unless you inform us otherwise in accordance with Opting out Clause, we may also use your Data to communicate with us (“Communications”):

1. a) by sending you notices regarding updates, changes or additions to our services or regarding any promotions which may be of interest
2. b) by inviting you to participate in our surveys;

4. d) by responding to your requests.

1. a) We will disclose Personally Identifiable Information as required by law, or if in our judgment it is necessary to protect Desi ChannelTv Inc. or our users from loss or liability, to enforce the general Terms of Use, this Privacy Policy or any other agreements executed with you or any related entity; to protect the rights, property or personal safety of other Users and/or the public, or to protect the business operations of website or application; where applicable, to credit reference agencies, where your Data may be used by other credit grantors for the purposes of:

iii. Accordingly, your Data will be disclosed where we are obliged or permitted by law to do so. If you post or send offensive or objectionable content to us or otherwise engage in any disruptive behavior in respect of website or application, we can use whatever Data that is available to us about you to stop such behavior. This may involve informing relevant third parties such as your employer and law enforcement agencies about the content and your behavior.

1. a) our use or processing, or the disclosure to, or use or processing by, Authorized Representatives, of your Data, including any Personal Information contained in your Data for the purposes mentioned above.
2. b) subject to opting out Clause, the use or processing of your Data, including any Personal Information contained in your Data, for the purpose of sending you any Communications; and

subject to opting out Clause, the use or processing by our Business Partners of your Data, including any Personal Information contained in your Data, for the purpose of sending you Business Partner Communications.

Opting Out:

If you do not want to receive information about our products and services or do not want to receive information from our partners and others about products and services that might interest you, you can send an email to Desi ChannelTv Inc. at privacy@desichannel.in. This e-mail address is being protected from spambots, you need JavaScript enabled to view it. We will keep track of your decision in our database. Even if you choose not to receive information from us, we reserve the right to communicate with you on matters we consider especially important relating to our products or services.

Retaining and Deleting Data

1.1 Upon termination of your access to website or application in accordance with the general Terms of Use, we may still be required to retain your Personal Information or Data in order to comply with legal obligations, prevent fraud, resolve disputes and troubleshoot problems etc, but always done within a legal framework.

1.2 When you request for your Data to be removed in accordance with Opting out Clause, you will be added to a suppression list to ensure your request is complied with.

Information Requests

1.1 You have a right to ask for a copy of your Personal Information and are obliged to correct any inaccuracies in your Personal Information. If you are unable to use our website or application to correct such inaccuracies, you may ask us to do so on your behalf (where possible).

1.2 Unless the Personal Information relates to an individual which you are legally responsible for such as a minor under 18, you may not give us Personal Information about any other person. If you do so, you confirm that they have appointed you to act on behalf of them, to consent to the processing of their Personal Information, including sensitive personal data, to the transfer of their Personal Information abroad and to receive on their behalf any Communications from us or any Business Partner Communications from our business partners.
